This website provides details of those Merchant Agents who, from time to time, are listed on the Register of Merchant Agents (“Website”). By using this website you agree to these terms of use. It is provided to you by Visa Europe Services Inc. a company incorporated in Delaware USA, acting through its UK establishment (establishment number BR007632) ("we", "us", "our" and “Visa Europe”). These terms of use are a legally binding agreement between you and us setting out the terms on which we make available to you the website and information it provides (“Terms”).

YOUR USE OF THE WEBSITE

The Website may only be used if in relation to Visa Europe you are currently or intend to be a member, a merchant, or a merchant agent.

You agree not to use the Website for any unlawful purpose, in any way that interrupts, damages, impairs the functionality of the Website or which endangers the security or integrity or any part of the Visa payment system, which includes illegal, false or deceiving business practices.

Your use of the Website grants you no rights in relation to our intellectual property rights (including, without limitation, copyright, trade marks, logos, graphics, photographs, animations, videos or text) or our intellectual property.

Your use of the Website grants you no rights in respect of being a member, merchant or merchant agent each of Visa Europe.

You agree that you will use any personal data we make available to you through this Website for the purpose only of evaluating your interactions or transactions with a member, merchant or merchant agent each of Visa Europe. In addition you agree not to: access any information or data on this Website using any robot, spider, scraper or other automated means for any purpose; breach the express or implied restrictions in any robot exclusion headers on this Website or otherwise circumvent any measures we deploy to prevent or limit access to this Website; or, “deep-link”, "frame", "mirror" this Website in whole or in part into any other website or application.

We accept liability for death or personal injury caused by our negligence or that of our employees and agents. We do not seek to exclude liability for fraudulent misrepresentation by us or our employees or agents. You have certain rights under the law. Nothing in these Terms is intended to affect these statutory rights.

If we breach these Terms, we shall only be liable for losses which are a reasonably foreseeable consequence of such a breach, up to a maximum of £1. "Foreseeable" means that the losses could have been reasonably contemplated by you and us at the time of entering into these Terms.

We are not responsible for: (i) losses not caused by our breach; (ii) indirect losses which means loss to you which is a side effect of the main loss or damage and where you and we could not have reasonably anticipated that type of loss arising at the time of entering into these Terms; (iii) failure to provide the Website (or any part thereof); or (iv) our failure to meet any of our obligations under these Terms where such failure is due to events beyond our control (for example a network failure).

GENERAL

If you breach these Terms and we take no action against you, we will still be entitled to use our rights and remedies in any other situation where you breach these Terms.

If you wish to take court proceedings against us you must do so within the United Kingdom. If you live in England or Wales the laws of England and Wales shall apply and if you live in Scotland, Scottish law shall apply.
